Redevelopment Overview

The Montclair Redevelopment Agency was adopted on June 6, 1977 and is made up of members of the Montclair City Council who also serve as the Agency Board of Directors. Provisions of State law enable the Agency to undertake community projects designed to improve certain areas within the City which have suffered economic decline, deterioration of improvements, or which have been unable to attract and promote new private investments to enhance the quality of life in the area.

The Agency is responsible for setting the course of redevelopment in the City of Montclair and for being sure that redevelopment plans are in the best interests of the Community. In directing the City Redevelopment activities, State law provides the Agency with broad governmental functions and authority to accomplish its purpose, including but not limited to: the right to issue bonds for authorized purposes and to expend their proceeds, and the right to acquire, sell, rehabilitate, develop, administer or lease property. The Agency may also demolish buildings, clear land, and cause construction of improvements including streets and sidewalks.

Montclair's framework for the future continues to rest on its solid foundation of past redevelopment activities. Current projects include the following:

  • Rejuvenate and upgrade areas of blight or neglect

  • Stimulate private investment

  • Strengthen the City's financial base including sales and property taxes

  • Improve and/or construct public infrastructure

  • Create and secure local jobs

Consistent with these goals, the Agency is actively involved in many projects and programs. A few of these include:

  • Affordable Housing Programs

  • Commercial Rehabilitation Programs

  • Economic Development Business Attraction and Marketing Programs

  • Capital Improvement Projects

    Montclair currently has five redevelopment project areas and its most recently adopted project area is entitled "Mission Boulevard Joint Redevelopment Project Area".

Redevelopment Continuation Status

As part of the strategy to close funding gaps in the State’s budget, AB1X 26 and AB1X 27 were signed by the Governor on June, 29, 2011. AB1X 26 eliminates redevelopment and suspends redevelopment agency activities, including incurring indebtedness or entering into or modifying contracts. AB1X 27 establishes a new Alternative Voluntary Redevelopment Program that allows cities to “buy-back” their agency then continue their work improving communities. On August 15, 2011, the City Council approved Ordinance No. 11-2921, which re-established the Montclair Redevelopment Agency under the Alternative Voluntary Redevelopment Program. The second reading of the Ordinance occurred on September 6, 2011.

Because the City Council voted to re-establish the Montclair Redevelopment Agency, the Agency was not required by the aforementioned new laws to file an Enforceable Obligation Payment Schedule (EOPS) by August 28, 2011. This EOPS process was reserved only for those agencies that were not planning to opt-in to the Alternative Voluntary Redevelopment Program. However, as a result of the Supreme Court’s “modified stay” issued on August 17, 2011 the opt-in legislation was “stayed,” while the legislation requiring agency wind down was left in force. This change required the Montclair Redevelopment Agency to comply with the wind down provisions and adopt an EOPS on September 21, 2011.

Transactions and Use Tax Oversight Committee - Determination of Compliance
On September 27, 2007, the Transactions and Use Tax Oversight Committee (TUTOC) met to review and discuss documents related to the annual expediture of General Fund revenues, as supplemented by transactions and use tax revenues, in support of Montclair Business Plan strategic priorities.
